1. The "Site" or "Web Site" or "Mobile Application" or "App" or "Us" or "We" or "Social Media Platforms" that are run and owned by Jack It Up Pvt. Ltd., marketed and/or managed byJack It Up Pvt. Ltd. are covered by this policy. In order to protect user information and bank information supplied for the purpose of using  Jack It Up services, it is policy to adhere to general legal requirements. This establishes rules for the handling of information about you and gives you various rights over your personal data.

1. Images, data, or files uploaded to the website cannot be utilised without the permission of the brand's authorised staff.

1. Jack It Up is dedicated to respecting and protecting the privacy of our Users. Jack It Up uses all personal information users provide, including phone number, address, current location, or e-mail address, to support the relationship between the User and Jack It Up. Its goal is to provide customers with better service through the development of new methods.

USE OF WEBSITE

1.  We shall do every effort to guarantee that the Website will be accessible without interruption and that transmissions won't include any mistakes. This cannot be ensured, though, given the nature of the internet. Warranty and Returns

• Jack It Up has a flexible 14-day returns policy.

1. Jack It Up has a simple return policy through which you may request the return or exchange of a product. These goods can only be returned unopened and sealed in their original packaging. 

1. Your requests will be completed once we receive the entire returned package of the items under consideration. Please go to the FAQs on our website for more details.

1. All products are covered by our 14-day easy return policy, which also applies to product exchanges. We will be pleased to replace any item for you if you're unhappy with the size or decide you'd rather have it in a different shade. 

User Guidelines 

1. You hereby undertake not to use the Website or the App for any purposes that are prohibited by any applicable laws and/or in violation of the provisions of these provisions of Use in exchange for Jack It Up granting you the rights set forth in this agreement. You must not use the Platform in any way that could endanger the safety, functionality, or performance of our server, any network(s) linked to any Jack It Up server, or the use and enjoyment of the Website or the App by any other person. You may not attempt to use any means, including hacking or password mining, to gain unauthorised access to any services or functions, other user accounts, computer systems, or networks. 

1. You must not use any method to acquire or attempt to acquire any materials or information that is not expressly made available through the Website and the App.
2.  You accept to receive transactional, informative, and promotional updates via SMS Messages & Email by providing your consent.
3. In spite of anything stated in the Terms of Use, you have the option to withdraw your consent and choose not to receive transactional updates and offers via WhatsApp and Google RCS in the event that you have given your approval to receive such communications.
4. All of the information you provide is truthful and accurate, and you promise to keep it that way.
5. You have access to the Website and the App solely for your own private, non-commercial use.
6. On the website or the app, you may not host, display, upload, change, publish, transmit, update, or share any information, or share or list any information or item that:

(i) belongs to someone else and you have no legal authority over it;

(ii) is egregiously hurtful, abusive, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invading another person's privacy, hateful, or racially or ethnically unpleasant, insulting, referring to or supporting money laundering or gambling, or otherwise unlawful in any way;

• hurt children in any form;
• Violates any proprietary rights, including any patents, trademarks, copyrights, or other rights;
•  disobeys any currently in effect law;

1. You are in charge of any activity that take place in your account. You consent to immediately alert Jack It Up of any unauthorised use of the account or any other security lapse. If you fail to notify Jack It Up of the loss or theft of your device and/or any unauthorised access to your account, whether with or without your knowledge, within a reasonable amount of time, Jack It Up will not be responsible for any loss you suffer as a result of your negligence.

1. Jack It Up will use all commercially reasonable steps to keep your information private. The loss or damage of the Device resulting from theft, carelessness, or your failure to follow safe computer practices, however, shall not be the responsibility of Jack It Up.

10. You must make sure that you always strictly abide by all current and applicable laws, rules, and regulations when using the functions and features. Jack It Up will not be held responsible in any way for any failure on your part to do so.
11. If your credit card is swallowed at an ATM, lost, stolen, not received, or used without your permission, you must tell your bank right away. For further safety measures to be taken in the event of loss, theft, or fraudulent use of your credit card, please refer to the full instructions you received from your bank.
12. All purchases made on the Platform must be made solely for the user's personal use. The user hereby expressly acknowledges that no product acquired by the user shall be offered for sale, resold, bartered, or utilised in any other way for profit-making ventures. The user agrees that it is prohibited to sell the purchased goods to third parties for profit.
13. When we believe it is necessary or appropriate to comply with a regulatory requirement, judicial proceeding, court order, government request or legal process served on Us, or to protect the safety, rights, or property of Our customers, the public, Jack It Up, or others, and to exercise, establish or defend our legal rights, we may disclose Your Personal Information as required by law to any competent law enforcement body, regulatory or government agency, court, or other third party. The disclosures are done solely for the reasons stated in this document, in accordance with our privacy statement, and in compliance with all applicable laws.
14. During the guest login process, you must enter your personal information, including your name, phone number, and email address. We will not be held liable in any manner if You provide information on another individual or false information. However, in the event of any discrepancy, We will work with You in the best manner possible by giving the aforementioned information that was entered at the time.

 INDEMNIFICATION 

1.  By accessing and using the Platform in violation of these Terms of Use and/or by violating any intellectual property or other rights of anyone, you agree to defend, indemnify, and hold harmless us and our representatives from and against any and all claims, damages, costs, and expenses, including attorneys' fees.
2. If these Terms of Use or your use of the Platform are terminated or cancelled, this clause's provisions will remain in effect.
3. As a result of an event or series of related events beyond Jack It Up's control, such as failures of or issues with the internet or a portion of the internet, attempted hacker attacks, hacker attacks, denial of service attacks, and/or viruses or other malicious software attacks or infections, Jack It Up shall not be liable for the loss and/or damage of the User's confidential information or data.
4. You do so at your own risk and judgement, and you alone are responsible for any loss of data or device damage resulting from the download of any material you choose to download or otherwise access through the Platform. There is no guarantee of any kind that is not specifically mentioned in these Terms of Use that may be created by any advice or information, whether oral or written, that you acquire from us through or from the service.

ON DELIVERY & SHIPPING POLICY

 

1. We deliver across India. The delivery process starts in 4-7 business days. During the guest login process, you must enter your personal information, including your name, phone number, and email address. We will not be held liable in any manner if You provided information on another individual or false information. However, in the event of any discrepancy, We will work with You in the best manner possible by giving the aforementioned information that was entered at the time. at the earliest.
2. Your products are carefully reviewed after our system has processed your order to make sure they are in flawless condition.
3. They are packaged and given to our reliable delivery partner after passing the final round of quality inspection.
4. The package is then delivered as soon as possible to you by one of our delivery partners. They will call you to rectify the problem if they are unable to do so at the time or at the address you have given.

SEVERABILITY

1. Any provision of these Terms of Use that is found to be invalid, illegal, void, or for any other reason unenforceable shall be deemed severable and shall not affect the validity and enforceability of any other provision of these Terms of Use.

Termination

1. Our Right: We reserve the right to block or otherwise restrict your future access to and use of the Website and the App, as well as to terminate your access to and use of the Website and the App, at any time and for any reason. In the event that the services are terminated or something bad happens as a result, we won't be responsible to you.

WAIVER

1. No term of these Terms of Use may be waived, and no breach may be forgiven unless Jack It Up agrees to do so in writing and signs it. Any expressed or implied permission by Jack It Up to, or waiver by Jack It Up of, any breach by users does not constitute consent to, waiver of, or justification for any other distinct or succeeding breach.

DISPUTE RESOLUTION AND GOVERNING LAW 

1. Indian law will be used to interpret and govern these terms of use. By using the Platform, you hereby expressly agree that any disputes arising out of or related to your access to and use of the Platform shall be exclusively subject to the jurisdiction and venue of courts located in Jaipur.
